This reservation is based on the published, online daily rate plus, administrative fee of $175.00 and a $600.00 refundable security deposit. The administrative fee encompasses the final cleaning of the unit upon departure as well as the criminal history check required by the property and is nonrefundable.

60% of the booking will be retained to cover these fees. The reservation balance is due upon check in.

This lease will continue month to month until notice to vacate is received from the Lessee for confirmation of departure no less than, 2 weeks, 14 days prior to departure or a confirmed departure date is given upon contract.

Pets are welcome at our community. Breed restrictions do apply, and pets are restricted to canines and felines. There is a $400.00 nonrefundable fee per pet required prior to pet move-in and $20.00 per month pet rent. Any damages that are caused by the pet of the Lessee may result in further charges. If an unreported pet is discovered in the unit, a $500.00 pet fee will be immediately charge to the method of payment on file.

Service animals are exempt from these fees however; documentation of the animal and verification is required.

PET ACKNOWLEDGEMENT (check one)

o I acknowledge I will NOT have a pet in my unit during my stay and understand if I am found to have an unreported animal, my card on file will be immediately charged.

o I acknowledge I WILL have a pet in my unit during my stay and I understand any damages caused by my pet including but not limited to defecation or urination on the carpets, scratches on the doors, walls or damage to the furniture will result in full loss of my $600.00 rental deposit as well as any additional charges for damages such as full carpet replacement, full paint and any repair of the dry wall or baseboards, doors or furniture replacement.

RESERVATION REQUIREMENTS EXTENSIONS or RENEWALS

Extensions or Renewals to this agreement need to be communicated as early as possible prior and may be subject to higher rates. Every attempt will be made to accommodate extension or renewal requests in this unit after official notice to vacate has been given but is subject to availability.

SECURITY DEPOSITS

There is a refundable security deposit of $600.00. The deposit will be refunded within 30 days after departure pending inspection of the apartment confirming that there are no damages beyond normal wear and tear, final clean charges, electricity or Wi-Fi data overages. Default of lease and unauthorized cable changes will result in full loss of deposits.

PAYMENT and LATE FEES

Lessee agrees to pay Premier Patient Housing, LLC for rental and other amounts due under this agreement to 4806 Mesquite Terrace Dr., Manvel, TX 77578 for the entire Initial Term and for all possible extensions and renewals.

The first invoice is due upon contract execution and will be pro-rated from the day of move in until the end of the 1st occupied month, plus the administrative fee and deposit; if a pet deposit is applicable, it will be charged at this time.

Future invoices are due on the 25th of the month. If the 25th falls on a weekend or holiday, the invoice will be due on the business day prior. Billing cycles for December 25th will occur on the 23rd or business day prior should it fall on a weekend.

If payment is not received by the third (3rd) day following the due date Lessee is subject to a one time (per invoice) late fee of $50.00 plus accrued interest at the rate of 1.5% per month, or the maximum allowable by law.

If payment is not received by the seventh (7th) day following the due date, Premier Patient Housing, LLC will exercise the right to initiate a lock change of the unit and prepare the unit for another patient within 3 business days. Arrangements to reclaim personal items must be made within 48 hours of the lock change. Unclaimed personal items will be donated to a local shelter.

Payments may be made by credit or debit card only. Debit card transactions will incur a $4.95 convenience fee and payments made by Credit Card will incur a 2.95% fee or fees outlined by merchant service provider not to exceed $5.95 for debit cards or 3.95% for credit cards. Additional fees may be charged by your banking provider to credit card issuer. We accept Visa, Master Card, Discover, and American Express.

DEFAULT of LEASE

Lessee will be in default of this agreement upon:

a) failure to provide day’s written notice to vacate,
b) failure to pay invoices in a timely manner,
c) vacating premises prior to agreement termination,
d) failure to comply with any other provision of this agreement.

Lessor will notify Lessee in writing of default and will be given a cure period to correct the condition of default. If Lessee does not correct the default condition by cure date, Lessor may take possession of the premises and terminate the agreement by means of key lock change and/or eviction within 7 days of lease default. In no event, however, is Lessee relieved of the financial obligations under this agreement. Premier Patient Housing, LLC reserves the right to take appropriate legal action, including action through the courts.

This agreement is governed by the laws of the State of Texas. Premier Patient Housing, LLC may accelerate amounts due and may use any security or other deposits to offset amounts due.

If collection or legal action is required, Lessee agrees to pay for appropriate and reasonable administrative and attorney fees.

Cable, Internet, Utility Outages:

Although cable via streaming services, internet, and utilities are included with your apartment, outages from inclement weather or technical issues can occur without notice. Once PPH is informed of an outage we will attempt to inform all guests and keep guests updated with information provided to us by the cable or utility provider. Utility outages are beyond our control and reimbursement will not be provided when an outage occurs.

INSURANCE, LIABILITY and INDEMNIFICATION

Lessee agrees to and does hereby indemnify, hold harmless and defend Lessor from and against any and all claims, obligations, liabilities and damages arising from, connected to or related to Lessee’s or any representative, contractor, employee of invitee of Lessee’s use of the Leased Premises or the Apartment Complex, even if caused in whole or in part by the negligent acts of omissions of Lessor (but excluding willful misconduct on the part of Lessor, respectively). Lessor shall not be liable to Lessee for any injury and/or damage to persons or property due to the condition, design, or any defect in the building or its mechanical systems that may exist or subsequently occur, or due to any tortuous or criminal acts or omissions (other than willful misconduct on the part of Lessor, respectively).

Lessor is not responsible for any damages to or loss of any of Lessee’s or Resident/Occupant’s (or guest’s) Personnel Property or for personal safety. It is recommended that personal renter’s insurance be purchased to cover all personal losses such as those due to theft, fire, smoke, and water damage.

Lessee agrees and acknowledges that no representations or warranties have been made to Lessee that any security is or will be provided at of about the apartment community and that neither owner nor Lessor will be obligated to provide any security. Any security, courtesy patrol, concierge or onsite management at the apartment community are not employed by or affiliated with Lessor.

INQUIRIES

Any inquiries regarding early departures, extending your stay, billing questions or any maintenance related needs or other questions should be directed to our sales office at 281.507.2035 or visit our web site at www.premierpatienthousing.com. Our normal office hours are 8:30 a.m. 4:30 p.m. Monday through Friday.

Our offices are closed on weekends and holidays. Premier Patient Housing maintains personnel available on-call during non-office hours via the 281.507.2035 number until 9:00 p.m. and is available via email. PPH encourages you communicate emergencies in this manner.

If you have lost or misplaced your keys after normal business hours, we are happy to assist and grant you access Monday – Friday, 9:00 a.m. – 4:30 p.m. at no charge. Lock outs AFTER office closures, weekends or holidays will be billed at $75.00 per occurrence.

We are unable to assist with lock outs after 9:00 p.m. or on holidays. If you are locked out of the building or your apartment unit after 9:00 p.m. you will need to arrange for accommodations at your own expense.

MAINTENANCE REQUESTS AND REPAIRS

We provide replacement light bulbs for lamps and batteries for TV remote controls. These items may be found in the utility closet with the washer and dryer.

All maintenance requests pertaining to the unit and fixtures in the unit should be reported to PPH’s office at 281.507.2035.

Water penetration due to storms, water leaks or running toilets should be reported immediately. Running toilets or water leaks that are not reported could cause a utility overage that Lessee may be liable to pay.

Non-emergency items such as replacement light bulbs for lighting fixtures such as track lights, island pendant lights, air conditioning filter changes and other minor maintenance issues have a 72-hour time frame for completion.

Move in Condition

Upon move in, you will have 48 hours to return the provided move in condition form reporting any damages you see as well as the number of keys/remotes/parking passes you received. The move in form will state how many remotes/keys/parking passes we left you. Failure to report any damages or missing keys/remotes/parking passes will result in you being held liable for these items.

SMOKING

Smoking is prohibited in all common areas of the property. Smoking is permitted on your unit’s balcony ONLY. Smoking found inside of your unit will result in a $400.00 charge. Please extinguish and dispose of cigarettes appropriately.

FIRE ALARM TESTING AND REPAIRS

The City of Houston or property owner may require fire alarm and other safety test or repairs inside the units and around the community. Random testing or repairs are beyond the control of Premier Patient Housing. Premier Patient Housing may request notification of testing in advance however; the city or property owner may not provide such notice.

Premier Patient Housing will attempt to notify all Lessees of any such testing if advised, however PPH will not guarantee notice will be given in time or during our normal business hours. By signing the lease, the Lessee understands and agrees to hold harmless Premier Patient Housing, property owner(s), Management Company or employees liable for any inconveniences that may arise during any fire alarm testing or repairs made on property or inside your unit.

Fire alarm inspections and testing will occur during normal property hours, if the alarm is sounding after hours, PPH encourages Lessees to exercise safety and vacate the unit until First Responders or Property Management advises you may safely return.

BIDETS

Installations of bidets, personal-hygiene sprayers, or other plumbing fixtures are not permitted per the property’s rules and City of Houston regulations. Unauthorized installations of bidets or other plumbing fixtures will result in a full loss of deposit. Any damages that occur due to unauthorized fixtures the Lessee will be held liable for. ${

UTILITY, CABLE, PARKING AND OTHER SERVICES

Included in the rate is a Utility allowance of $150.00 per month for a 2-bedroom unit. Utilities include water, trash, gas and electricity. Any overages will be invoiced at cost plus a 20% administrative fee. Cable streaming via AT&T Now and WI-FI are included in the rate. Changes or charges to the AT&T Now package or Amazon account without our knowledge or consent are prohibited. Any unauthorized changes to the unit cable package will result in a full loss of deposit and possible disconnect of cable.

Please observe parking signs. 2 unreserved parking spaces are provided within the garage; guests must park on the top level of the garage. Parking passes must always be displayed on the vehicle dashboard. Unauthorized parking may result in towing and impounding. Premier Patient Housing, LLC will not be held responsible for vehicles towed and impounded.

FINAL CLEANING REQUIREMENTS:

The final clean of the apartment unit will be completed by Premier Patient Housing however the unit must be left in the same condition it was leased. The following items left in the below conditions will be billed at additional cost.

  • Black, yellow, red or any other stained color tubs/showers will incur a charge of $75.00.
  • Oven and stove tops with burned on food or grease will incur a charge of $75.00.
  • Refrigerators/freezers left with food and/or any liquid stains such as spilled drinks or other food items will incur a charge of $50.00.
  • Carpets left with stains will incur a charge of $100.00. Carpet damaged beyond repair, the Lessee will be liable for all charges associated with new carpet installation including but not limited to furniture removal and storage. Replacement carpeting or flooring is completed by the contracting company of choice by property management and will be billed at an additional 20% to the contract rate.
  • Furniture upholstery damaged or left with stains will incur a charge of $75.00. If the upholstery is stained or damaged beyond repair, Lessee will be liable for full replacement cost.
  • Trash, personal items, or food left behind will be charged $25.00 per bag.
  • Please ensure all medication and personal items have been removed from the unit upon your departure; PPH will not hold personal items such as clothing. Items in good condition will be donated to a local shelter.BY CLICKING ACCEPTANCE, LESSEE IS CONFIRMING THIS RESERVATION AND ACKNOWLEDGING THE TERMS, POLICIES AND CONDITIONS CONTAINED HEREIN. PLEASE ENSURE THEY HAVE BEEN READ CAREFULLY.

Notice of Intent to Vacate Policy:

A two week (14 day) written Notice of Intent to Vacate is required prior to check out even if departure IS PRIOR to end of booking date. Verbal notices are not accepted however, email is permitted as long as Lessee receives a reply from PPH confirming receipt. Lease will continue month to month until Notice of Intent to Vacate has been received.

Failure to give a 14 day notice to vacate for any reason including but not limited to unknown length of stay, date/treatment plan changes or any other reason will result in being charged for each day of insufficient notification. ${i:1:y

By clicking acceptance of Terms and Conditions, Lessee affirms that they have read and fully understand the terms set forth in the above Notice of Intent to Vacate. Lessee also understands by accepting the Terms and Conditions, the notice to vacate policy, Lessee confirms and agree with the terms, policies, and conditions contained herein.

Cancellation/Early Termination

Premier Patient Housing, LLC strives to be as flexible as possible and at the same time offering the best rates we can. To do this we must implement strict policies. However, we understand there can be circumstances out of your control that may require a cancellation or early termination of a lease. For this reason, we have a cancellation and early termination policy. Cancellation/early termination of a lease for any reason including but not limited to date/treatment plan changes or appointment/project cancellations may be honored under certain circumstances, however charges will be assessed. No cancellations are permitted.

SHUTTLE RELEASE

This Shuttle Release (this “Release”) is entered into by the undersigned (the “Resident”, whether one or more), resident(s) of the Premier Patient Housing (the “Apartments”) for the purpose of releasing certain parties, as identified below, from any and all responsibility or liability with respect to Resident’s use of the shuttle service (the “Shuttle”) provided by the Owner of the Apartments (the “Owner”). For and in consideration of being allowed to ride on the Shuttle and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Resident hereby agrees as follows:

1. Use of the Shuttle. Resident hereby represents that Resident: (i) assumes all risks and responsibilities with respect to any loss, claim, damage or injury to person or property relating to or arising out of Resident’s riding on or use of the Shuttle; (ii) will wear seatbelts at all times while the Shuttle is in motion; (iii) comply with all rules of the Owner or the Owner’s representative with respect to riding on, or the use of, the Shuttle; (iv) will not engage in horseplay or disruptive, loud or obnoxious behavior while on the Shuttle; and (v) will not consume food or drinks (other than bottled water) on the Shuttle. Resident understands that there is a maximum amount of people that can ride on the Shuttle and that, even though Resident stands in line for a Shuttle and signs this Release, Resident may be denied access to the Shuttle if full. Resident further represents that at all times, Resident will supervise and maintain custody and control over any minors riding with Resident on the Shuttle.

2. Release. Resident, on Resident’s own behalf and on behalf of all guests and occupants of Resident that may also ride the Shuttle, hereby releases, discharges and forgives the Owner, the Apartments, Alliance Residential, Premier Patient Housing, LLC and their respective affiliates, officers, directors, shareholders, partners, agents, employees, successors and assigns from any and all liability, responsibility, injuries, claims, damages, or causes of action of any nature whatsoever, whether in contract, in tort or by statute, Resident has or may have or might sustain arising out of, relating to or connected with riding on the Shuttle or transporting Resident to any events, activities, classes or any other destinations.

Resident(s) hereby agree(s) to execute this Release by accepting the Terms and Conditions.
